Navigating the Federal Vape Ban

Last year, as an initiative to reduce the use of e-cigarettes by teenagers, the Trump Administration banned most flavored nicotine pods except for menthol and tobacco flavors. 


This ban was feared by thousands of small business owners who were to be affected by the ban, as well as millions of American consumers who used flavored vape products as an alternative to more harmful cigarettes. 


How does the industry and businesses like yours stay afloat?    

Regulations of Trump’s vape ban 

While the Trump Administration first motioned a blanket ban of flavored e-cigarette and vaping products, two months later they reconsidered that approach, allowing the use of menthol and tobacco flavors.  


During this time, the Administration also passed a plan prohibiting the sale of cigarettes and e-cigarettes to children under the age of 21. This was the Trump Administration's attempt to combat the teen vaping epidemic, and it was motioned right as a mysterious lung illness tied to vaping, causing several deaths.    


The federal vape ban restricts the sales of most flavored pods, which are popular among teens. However, flavored e-liquid nicotine for open tank devices will be exempt. This doesn’t affect much for teens and their habits, as most underage vapers aren’t filling their own tanks or mods, they are just using a Juul or pod system.           

Types of e-cigarettes    


There are two types of e-cigarettes on the market, which can be classified as closed and open systems.

  • Closed system e-cigarettes, like Juul, use ready-made refills that screw directly onto the e-cig’s battery.

  • Open systems include a removable mouthpiece so the liquid that is vaporized can be refilled manually by the user.

Both closed system and open system e-cigarettes contain a rechargeable battery. Some devices have a coil with a refillable pod, while others use pods that snap directly to battery for easy use. It’s all up to user preference.
